  • D. Interpretation

    The constitutional law of Korea, Article 9, states that, “The State shall strive to sustain and develop the cultural heritage and to enhance national culture.” The national culture stated in this law clause includes not only specific traditional cultures such as Hanbok and Korean traditional music, but also the whole principle of a cultural nation. Therefore, this provision implies that the state should ensure that not only the development of culture but also the people can enjoy an appropriate cultural life. The government is making efforts for the underprivileged to enjoy cultural rights through various policies, which promote the cultural welfare of the underprivileged and resolve the cultural gap between the classes. Particularly, the right to use integrated culture targeting the basic recipients and lower income families is being supported for various leisure activities such as movies, music, and sports within less than 50,000 won per person. Looking at the current status of operations, only 37% of the marginalized population in 2011 grew 68% in 2015, and 58% in 2016. Given the fact that low-income earners do not enjoy leisure activities due to the lack of time, it is necessary to change not only the cultural policy but also the conditions in which the whole society can enjoy leisure in their lives.
